LAND OWNERS : What is your opinion on this ?

In your opinion, do you think that a landowner should have the right to put restrictions on property that he/she is selling?

I recently looked at a piece of property and the owner wanted 45 thousand for the property ( no house ). He said the house had to be stick built, so many square foot of living space, no animals, no cars that doesn’t run, couldn’t drill a water well ( this property is out in the country ) can’t have a private septic system..etc,.etc.

My belief is that once a person pays that kind of cash for a piece of property, it should be the buyers property.

The seller would feel like an idiot and be degraded if we made stipulations that the seller had to spend the money on certain things and certain places providing we bought the property.

** I know what some of you will say, they just want a clean neighborhood. That’s not the point, if that was the case, stipulate in the contract to keep your place clean and free of junk. Instead, people are having to design their homes to other peoples taste.

How do you feel about this ?

    I may be wrong, but I think you are dealing with a Deed Restricted property. If so, all the restrictions should be on a form. I bought property in an area like this. I bought because i thought it would lower riffraff from coming into the area. Getting these restrictions enforced is harder than it would seem. It required me to take the person violating the restrictions to court. Check into this further, and I’ll bet you find fees are also involved with living in the area. Sounds almost like a Home Owners Association type property. These can be a real pain in the @ss.

    It is perfectly legal if you are intending to lease the property for you to be forced to abide by certain rules. If you intend to buy the property "Out right", then they should not be able to tell you what you can and can not do to YOUR property.     There is a lot of files to read, but when you have the time, it’s well worth it in the long run………Especially if you want the gov. to leave you alone on your own property.

    I say that it’s fine as long as they are up front about the restrictions. If you don’t like the restrictions go somewhere else.
