Louisiana law?

As a land owner that does not own the mineral rights to said land, what rights do I have in regards to an Oil Company placing an oil or gas well on my property. Is there a required distance from a dwelling? Is there compensation for surface usage of the property.

    There is payment for damage to the surface land.

    The rest of that is in case law that I no longer remember. Contact a second year law student at LSU; they just studied that issue!

    Usually an owner of property owns the mineral rights to that property unless they signed them away. Now Louisiana is unique in that while all other states are based on British common law….it is based on the French Nepoleanic code so its laws are different in many respects.

    But you need to get an attorney in your area to address this…you may be entitlted to substantial compensation.
