Apparently in Texas a land owner only owns the rights to the surface of his or her land. Somebody who owned the land 100 years ago may own the mineral rights.
The oil companies use this as a way to drill on our land without our permission.

As a land owner that does not own the mineral rights to said land, what rights do I have in regards to an Oil Company placing an oil or gas well on my property. Is there a required distance from a dwelling? Is there compensation for surface usage of the property.
